By virtue of a decree heretofore granted in the case of The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2006-1 Trust against Ella Mae Trapp, I, the undersigned Special Referee for Fairfield County, will sell on Monday, November 5, 2018, at 11:00 A.M., at the Fairfield County Courthouse, Fairfield County Courthouse, 101 South Congress Street, Winnsboro, South Carolina, to the highest bidder: All that certain piece, parcel, or lot of land, with the improvements thereon, situate, located, lying, and being in the County of Fairfield, State of South Carolina, the same being shown and delineated as a Lot containing (1.00) Acres, more or less, upon a Plat prepared for Forman Williams, Jr. by W. D. Bozard, RLS dated October 4, 1990 recorded in the Office of the Office of the Clerk of Court for Fairfield County in Deed Book LF at Page 49, which Plat is incorporated herein; and having the following boundaries and measurements: North by Tract D, whereon it measures (225.13’) Feet; East by State Road S-20-38, whereon it measures (233.36’) Feet; South by the Center-Line of a 30-Foot Wide Road, whereon it measures (213.50’) Feet; West by Property N/F Williams, whereon it measures (182.60’) Feet; all measurements being a little more or less. This conveyance subject to the Easement of a Thirty-Foot Wide (30’) Road going over through and across the entire southern Border of the subject property as shown and delineated upon the Plat referenced above; and the right, title and Interest of the persons whose property abuts the road to the use of the same. Being the same Property conveyed to Ella Mae Trapp by Deed from Ditech Financial, LLC Successor in Interest to Green Tree Servicing, LLC by Deed dated November 18, 2015 and recorded in the Office of the Clerk of Court for Fairfield County on December 4, 2015 in Book 1213 at page 240. TMS No. 104-00-03-051-000. CURRENT ADDRESS OF PROPERTY IS 2817 Airport Road, Winnsboro, SC 29180. SUBJECT TO ASSESSMENTS, FAIRFIELD COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES, IF ANY. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at the conclusion of the bidding, Five per cent (5%) of the bid in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder.) No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. Purchaser to pay for preparation of the Special Referee’s deed, documentary stamps on the deed, recording of the deed, and interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 9.500% per annum.
