AMENDED NOTICE OF SALE
2019-CP-20-00258 BY VIRTUE of a decree heretofore granted in the case of: Vanderbilt Mortgage and Finance, Inc. against Michael Kenneth Williams a/k/a Michael K. Williams, Susanne W. Williams a/k/a Susanne Walraven Williams, and all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, I, the undersigned Special Referee for Fairfield County, will sell on June 2, 2020, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land with all improvements thereon, lying being and situate in the County of Fairfield, State of South Carolina, and being shown and designated as portion of Lot or Tract B as shown on plat entitled Estate of Maggie A. Smarr dated October 15, 1949, prepared by H.W. Shaw, C.E. and recorded in the Office of the Clerk of Court for Fairfield in Plat Book 4, Page 188, and being more particularly described as 7 acres more or less as shown on plat being recorded in Plat Book 605, Page 1562, having such metes, bounds, courses and distances as reference to said plat will more fully appear. Also includes a mobile/manufactured home, a 2006 CLAY Mobile Home VIN# CLF007600NCAB This being a portion of the property conveyed unto Michael Kenneth Williams and his children by deed of Ada Smarr Douglas dated September 28, 1977 and recorded December 23, 1977 in Book E-7 at Page 57 in the Office of the Clerk of Court for Fairfield County. Thereafter, Martein L. Williams and Sundie M. Williams, children of Michael Kenneth Williams, conveyed their interest in the property unto Michael Kenneth Williams by deed dated December 6, 2007 and recorded December 18, 2007 in Book 882 at Page 137 in the aforementioned Clerk’s Office. TMS No. p/o 043-00-00-072-000 Property Address: 7841 Camp Welfare Road, Great Falls, SC 29055 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 9.1500%.
