Waters and Sylvia Waters aka Sylvia D. Thomas Sprott, Jr., Special Referee for Fairfield County, dated August 5, 1992 and recorded August 5, 1992 in Deed Book MB at Page 262; thereafter, Secretary of Veterans Affairs conveyed the subject property to Bankers Trust Company of California, N.A., as Trustee for Vendee Mortgage Trust 1994-1, without recourse, except as provided in the Loan Sale Agreement dated February 1, 1994 by deed dated February 24, 1994 and recorded March 17, 1994 in Deed Book MW at Page 14 in the Office of the Clerk of Court for Fairfield County, South Carolina. TMS No. 144-04-04-016-000 Property Address: 102 Sand Creek Drive, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder).
