BY VIRTUE of a decree heretofore granted in the case of: Wells Fargo Bank N.A., as trustee for Green Tree 2008-MH1 against Tracy Chisum aka Tracy Chisum, Sr., The South Carolina Department of Motor Vehicles, CFNA Receivables (TX), LLC a Texas limited liability company f/k/a CFNA Receivables (TX), Inc., a Texas corporation, successor by merger to CFNA Receivables (SC), Inc., f/k/a CitiFinancial, Inc., a South Carolina corporation, and Portfolio Recovery Associates LLC assignee of GE Capital Retail Bank/Care Credit, I, the undersigned Special Referee for Fairfield County, will sell on September 4, 2018, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that lot of land lying approximately four (4) miles south of Winnsboro in the County of Fairfield, State of South Carolina, being shown on plat of Greenbrier Acres, Phase II, dated July 26, 1995, made by Glenn Associates, Surveyors, recorded in Slide 537 at Page 1161, containing 1.26 acres, more or less, and as shown thereon is designated as Lot “14” and being bounded in the Northwesterly side by lands of Haslett, whereon it measures 376.93 feet, the Northeasterly side by lands of Haslett, whereon it measures 145.00 feet, on the Southeasterly side by Lot 15, whereon it measures 377.83 feet, and on the Southwesterly side by a chord of a curve along the right of way for Peach Road, whereon it measures 145.03 feet, more or less, and being a portion of the same premises conveyed to Frances D. Haslett, as Trustee of the William E. Haslett Testamentary Trust by Deed recorded in Book “KP” at Page 167 on November 30, 1992. See also Record of Will of William E. Haslett recorded in the Office of the Judge of Probate for Fairfield County in File 92-EE-20-46. This lot is a portion of a tract of 241 acres, more or less, conveyed in William E. Haslett, deceased by Deed of Frances D. Haslett recorded in Book “LQ” of Deeds at Page 316 on September 11, 1991. Reference is also made to more recent recorded plat prepared for Tracy Chisum dated August 27, 1998 and recorded September 21, 1998 in Plat Book PI at Page 149. This conveyance is subject to restrictive covenants recorded in Book “MQ” of deeds at Page 31 on the 29th Day of September, 1995. In addition to any other limitations contained herein, this conveyance is subject and subordinate to the following to extent they now exist and affect the within described premises; A. Any and all existing easements and servitudes affecting the premises whether arising from written instrument, operation of law or otherwise, and, B. Any and all conditions, restrictions or reservations affecting the premises except that the same are not imposed hereby, and, C. Liens for roll-back taxes affecting the premises, the liability for payment of which is assumed by Grantee by acceptance of deliver of this deed, and D. Any restrictions or liens imposed by statute, ordinance, law or regulation affecting the premises including but not limited to those dealing with zoning, land use and disposal; and storage of hazardous materials. Together with all and singular, the rights, members hereditaments and appurtenances to the said premises belonging or in anywise incident or appertaining. To have and to hold all and singular the premises before mentioned unto the said “grant”, his heirs, successors and assigns forever, subject and subordinate to limitations contained herein, And I do hereby bind myself and my heirs and personal representative, to warrant and forever defend M22 and singular the said premises unto the said “Grantee”, his heirs, successor and assigns, against me and my heirs, and against every person whomsoever lawfully claiming, or to claim, the same or any part thereof, subject and subordinate to limitations contained herein. Also includes a mobile/manufactured home, a 1998 Pioneer VIN: PH2407GA2942AB Being the same property conveyed to Tracy Chisum by deed of Frances D. Haslett, as Trustee of the William E. Haslett Testamentary Trust, dated September 11, 1998 and recorded September 21, 1998 in Deed Book PI at Page 146. TMS No. 212-00-02-025.001 (per mortgage) 182-03-02-005-000 (Land) (per assessor) 182-03-02-005-001 (Mobile Home) (per assessor) Property Address: 1466 West Peach Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 2.0000%.
