BY VIRTUE OF A DECREE of the Court of Common Pleas for Fairfield County, South Carolina, heretofore issued in the case of HSBC Bank USA, N.A., as Trustee on behalf of ACE Securities Corp. Home Equity Loan Trust and for the registered holders of ACE Securities Corp. Home Equity Loan Trust, Series 2005-SD3, Asset Backed Pass-Through Certificates vs. Martha A. Miller; , I the undersigned as Special Referee for Fairfield County, will sell on March 5, 2018 at 11:00 AM, at the County Court House, Fairfield County, South Carolina, to the highest bidder:
Legal Description and Property Address:
All that certain parcel or tract of land, with improvements thereon, lying, being and situate in Fairfield County, in the State of South Carolina, designated as Lot #43 on a plat by Oliver Johnson, dated April 12, 1947 and recorded in the Office of the Clerk of Court for Fairfield County in Book “4” of Plats, at Page 90, bounded on the North by Alexander Circle, on the East by Lot 44 on said plat, now of formerly of Ella Bell Green, on the South by Lot No. 55 on said plat and on the West by Lot 42.
This being the same property conveyed unto Thackeray J. Miller a/k/a Thackery J. Miller and Calvin Miller by Deed of Stewart-McMeskin Company dated March 6, 1953 and recorded March 9, 1953 in Deed Book CI at Page 269, in the Office of the Register of Deeds for Fairfield County, South Carolina.
Subsequently, Calvin Miller passed away and his interest in the subject property was passed to Thackery J. Miller pursuant to the Will of Calvin Miller and by probate of Estate File No. 92ES20-124. See also Deed of Distribution dated June 3, 1993 and recorded June 7, 1993 in Deed Book ML at Page 285, in the Office of the Register of Deeds for Fairfield County, South Carolina.
Subsequently, Thackery J. Miller passed away and her interest in the subject property was passed to Daniel E. Miller, Martha A. Miller, Reginald Jonathan Miller, Sr., Steven Clayton Miller, Reuben Lavender Miller, Sr., Janie Verlet Miller-Coleman, Henry Harper Miller, and Vera Lavelle Miller-Bilal pursuant to the Will of Thackery J. Miller and by probate of Estate File No. 99ES20-45. See also Deed of Distribution dated April 20, 2000 and recorded April 20, 2000 in Deed Book QH at Page 254, in the Office of the Register of Deeds for Fairfield County, South Carolina.
Subsequently, Reginald Jonathan Miller, Sr. passed away and his interest in the subject property was passed to Martha A. Miller pursuant to the Will of Reginald Jonathan Miller, Sr. and by probate of Estate File No. 2003-ES-20-00130. See also Deed of Distribution dated May 15, 2004 and recorded May 17, 2004 in Deed Book 650 at Page 56, in the Office of the Register of Deeds for Fairfield County, South Carolina.
Thereafter, Daniel E. Miller; Henry Miller; Janie M. Coleman; Ruben Miller a/k/a Reuben Lavender Miller, Sr.; Vera M. Bilal, and Steven Miller conveyed the subject property to Martha A. Miller by Quit Claim Deed dated June 6, 2007 and recorded July 9, 2007 in Deed Book 855 at Page 191, in the Office of the Register of Deeds for Fairfield County, South Carolina.

TERMS OF SALE: For cash. Interest at the current rate of Seven and 80108/10000 (7.80108%) to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Special Referee for Fairfield County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Thirty (30) days, the Special Referee shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. If the Plaintiff or the Plaintiff’s representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record.
