NOTICE OF SALE 2017-CP-20-00128 BY VIRTUE of a decree heretofore granted in the case of: The Bank of New York Mellon FKA The Bank of New York, as Trustee for the certificateholders of the CWABS, Inc., Asset-Backed Certificates, Series 2006-14 against John D. Sneed and Christina Myers, I, the undersigned Special Referee for Fairfield County, will sell on December 4, 2017, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or tract of land lying about eight miles south of the Town of Winnsboro, in the County of Fairfield, State of South Carolina, containing 4.30 acres, more or less, and being more particularly shown on a plat prepared for George H. Franklin by E.F. Owens, RLS dated October 22, 1973 and recorded in the Office of the Clerk of Court for Fairfield County in Deed Book “EJ” at Page 406 and having such shape, metes, courses and distances as are shown on said plat, reference being made to said plat for a more complete and accurate description. Being the same property conveyed to John D. Sneed by deed of Robert F. Schnelle, dated July 25, 2006 and recorded July 27, 2006 in Deed Book 793 at Page 57; thereafter John D. Sneed conveyed the subject property to John D. Sneed, Jill Sneed,and Christina Myers, as joint tenants with the right of survivorship, which deed was recorded on August 21, 2006 in Deed Book 797 at Page 179; thereafter, Jill Sneed died on July 7, 2016, leaving John D. Sneed and Christina Myers as owners of the subject property by right of survivorship. TMS No. 225-00-00-003 (per mortgage) 198-00-05-030-000 (per assessor) Property Address: 2999 Greenbrier Mossydale Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 4.0000%.
