STATE OF SOUTH CAROLINA IN THE COURT OF COMMON PLEAS 6th Judicial Circuit CASE 2016-CP-20-262 Mary Kennedy McDaniel, Fred C. Kennedy,Jessie Kennedy Adkins, and Forestine Kennedy Coad, Plaintiffs, v. Audrin Kennedy, South Carolina Department of Revenue, United States of America, and Grandison Kennedy, believed to be deceased but whose name is published herein to give notice of this action to any person claiming under him, (other than the Plaintiffs) and (as Defendants whose true names are unknown for any reason including but not limited to marriage) any child, or children and heirs at law or devisees, distributees of the above named person if they or any of them be dead, and any and all persons entitled to claim by, through, or under him, or any of them; also any and all other persons unknown claiming any right, title, estate, interest in or lien upon the real estate described in the complaint herein, all such unknown adults who being as a class designated as John Doe, and all such persons who are under 18 years of age, incompetent, incarcerated, in the military service or suffering from some other legal disability being as a class designated as Richard Roe, Defendants. By virtue of a Decree and Order heretofore granted in the case of Mary Kennedy McDaniel, et. al. v. Audrin Kennedy, et.al. as captioned above, the undersigned Michael Paul Swearingen as Special Referee for Fairfield County will sell on Monday June 5, 2017 at 11:00 A.M. before the Courthouse door of the Fairfield County Courthouse, Corner of Congress and Washington Street, Winnsboro, South Carolina to the highest bidder the following property to wit: All that certain piece, parcel, or lot of land, with improvements thereon, lying and being near the Town of Winnsboro, County of Fairfield, State of South Carolina, containing 59.59 acres, more or less, and being more particularly described as Tract “A” on a plat of survey prepared by Knight Surveying and Mapping, LLC on June 3, 2016 and recorded on March 14, 2017 in Plat Book 605 at page 2669 in the Office of the Clerk of Court for Fairfield County, and having such shape, metes, bounds, courses, and distances as are shown on said plat which is incorporated herein by reference and made part of this description. Tax Map #: Portion of 194-00-04-059-000 as follows: Terms OF SALE: FOR CASH The successful bidder will deposit with the Special Referee, at the conclusion of the bidding, five per cent (5%) of his bid, (in cash or equlivant) as evidence of good faith, same to be applied to purchase price in case of compliance, but may be forfeited in the case of non-compliance without further hearing. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms of the bid and close within twenty (20) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent sales day (at the risk of the said highest bidder). The bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. Purchaser to pay for deed prep, documentary stamps, and recording of the deed from the special referee. The sale shall by subject to taxes, and assessments, and existing easements and restrictions of record. PLEASE TAKE SPECIAL NOTICE REGARDING TIMBER The sale is subject to the temporary timber rights to cut and remove all of the timber conveyed to D.J. Creed, Inc. which expire in one (1) year (AND AT THE END OF ONE YEAR BEING MARCH 31st 2018 ALL THE TIMBER RIGHTS SHALL REVERT TO THE PURCHASER AT THIS SALE OR HIS HEIRS AND ASSIGNS) and to all matters of record and any interested party should perform an independent title examination of the subject property as no warranty is given by the Special Referee.
